There are several steps to the SIJV process. First, the State Courts must issue a Special Finding Order and a ‘child’ must be declared a dependent of the Juvenile court system. In Maryland, a child is eligible to file for Special Immigrant Juvenile Findings in Juvenile court up until the age of 21. In Virginia, the cut off age is 18. 

Next an I-360 Petition must be filed and approved with U.S. Citizenship & Immigration Services (USCIS). Finally, the Department of State (DOS) determines through a complex priority system when a ‘number’ is available for a child to receive his or her Green card from USCIS.

Our lawyers successfully navigate the system for our children, guardians, and sole parents. We also provide representation at the State and Federal level until Permanent Resident status is granted to the minor child.
