Recently, our law firm was contacted by a 70-year-old U.S. citizen that was at their wits end. The problem…he was caring for his 98-year-old mother who lived in another state. He contacted us to find out if he could sponsor a national from the Philippines to come into the United States to care for his mother on a full-time basis. He had run ads and tried to network to find qualified and interested individuals to care for his mother, but to no avail.
Well, he was relieved to learn that we could help. A temporary work visa is required for a foreign national to enter the United States as a caregiver. The ability to navigate the correct visa and meet the federal regulations is challenging. However, the options include H-2B, J-1, and L-1 visas to name a few non-immigrant visa options we use when representing U.S. Citizens petitioning for non-citizen workers to enter the United States for the specific temporary purpose of caregiving.
Also, permanent employment of a foreign national caregiver is possible with long term advance planning for one’s aging parents. Permanent Resident Adjustment of Status (or as it’s referred- Green Cards) may be sponsored by a U.S. Citizen through the Employment Based Category Three (EB-3) designated through the Department of State. This alternative allows a foreign national to immigrate as a permanent worker to the United States after meeting a market test with through the Department of Labor.
