5 Things You Need to Know About President Trump’s Executive Orders

Today marks the official transition of power from a Democratic administration to a Republican one. With President Trump back in office, many of us feel a sense of uncertainty, wondering what this means for the U.S. immigration system. As an immigration lawyer who has guided clients through five different presidential administrations—and whose Washington, D.C.–based legal team has 30 years of experience—I want to reassure everyone that we’ve been here before. In his inaugural address, President Trump reiterated a few of his immigration priorities. Some of these may sound familiar from his previous time in office. Let’s focus on the facts we know so far, and leave speculation aside:

1. Asylum Applicants Required to Remain Outside the U.S.

President Trump has indicated that asylum seekers arriving at the southern border will need to remain in Mexico (or another country) while awaiting permission to enter the United States. This “Remain in Mexico” concept was in effect during his last term and isn’t new. Historically, there were also discussions about requiring individuals to apply for asylum in other countries before reaching the United States. We will have to wait to see precisely how the administration will implement these protocols this time around.

2. No More ‘Catch and Release’

President Trump emphasized an end to “catch and release,” meaning individuals who arrive at the border seeking asylum may no longer be released into the U.S. after a brief screening. Instead, the administration suggests they will be detained until an asylum decision is reached. Previously, under “catch and release,” asylum seekers would receive a Notice to Appear in immigration court (NTA), often be granted a brief “credible fear” or “reasonable fear” hearing and then be released pending their next court date. While it’s unclear how long people might be detained under the new directives, the President has hinted at potentially sending more immigration judges to border facilities to expedite the process.

3. A Familiar Policy Focus

These changes reflect President Trump’s broader focus on border security and rigorous vetting of individuals entering the country. During his last term, the government shifted resources and personnel toward stricter enforcement at the southern border and introduced policies to minimize asylum seekers’ ability to wait inside the U.S.

Importantly, it appears that his stance on other immigration avenues—like the I-601A Provisional Waiver Program—may remain unchanged for now. In the past, President Trump did not actively dismantle this waiver process, and he has also spoken favorably (at times) about DACA recipients who are hard-working and pursuing higher education or professional goals.

4. Staying Informed, Staying Calm

It’s natural to feel nervous when changes to immigration policy are announced, especially if you or your loved ones are directly impacted.
